General Terms and Conditions: 

1. The Regulations define the terms and conditions of services provided to Customers by “Performance Clinic and Regatta Coaching” Organizers (Service Providers) – Karol Jączkowski Sportowe Lato and Yachting Jacek Turczynowicz.
2. The provisions of the Regulations specify in particular: the method of ordering and using the Service (training, boat charter) and making payments, the rights and obligations of the Parties, and information of an orderly nature.
3. The Customer declares that he has read the Regulations before ordering the Service, accepts its content and undertakes to comply with it.
4. The Service Providers reserves that the “Performance Clinic and Regatta Coaching” is made available to the Customer „as it is” and the process of developing and updating the program depends on the sole decision of the Service Providers.
5. The Service Providers are Karol Jączkowki running a business under the name of Sportowe Lato Karol Jączkowski, with its registered office in Charzykowy at Krótka 3 Street; 89-606; Tax No. 5552070780; e-mail: karol1094@wp.pl and Jacek Turczynowicz running a business under the name of Yachting Jacek Turczynowicz, with its registered office in Warsaw at Gen. Placement of the order 

6. Each Coaching Service or Boat Charter is provided with a detailed description and the client is obliged to select the right service after getting acquainted with the scope of the service. 
7. The Customer orders the Service by choosing required service, completing the registration form available on the website  and confirming that the Customer has read the Terms and Conditions and accepts them in electronic form (i.e. by checking the appropriate box on registration form).
8. In the registration form, the Customer, in addition to his identification data, provides contact details for the Service Provider (check Privacy Policy).
9. The customer is obliged to provide true and current data during registration. The Service Provider reserves the right to verify the correctness of the entered data and refuse to register the Service in the event of irregularities in the above-mentioned data.
10. The Service Provider accepts the order by confirming the order via e-mail to the Customer’s email address indicated in the registration form.
11. The contract for the provision of the Service by the Service Provider to the Customer is concluded on the day of receiving the first installment of the payment. Payment has to be made in accordance to schedules given in the specific offer and  be free of any bank commissions. Any bank fee will be charged to the Customers.

Cancelation Policy

13. Service Provider has the right to cancel a Service 31 days prior to the event if for any reason the service cannot be carried out. In such a case the customer is entitled to a full refund of any prepaid service. 
14. As for the Customers, their cancellations of the activity, are eligible for refunds in accordance to the following: 

• Cancellations made 31 days or more in advance of the event date, will receive a 70% refund. 
• Cancellations requests made within 30 days and less prior to the Event will not receive any refund.

15. We highly recommend that Customers purchase travel insurance to protect themselves from unforeseen circumstances that may make them unable to attend the Event. 
16. Missed Days – No credits or refunds are provided for days of sailing missed, including days missed due to travel delays, weather conditions, sickness, family emergency or injury.

Privacy Policy

17. We are the sole owners of the information collected during registration and we will not share your information with any third party outside of our organization, other than as necessary to fulfill the Service.

Right to use names and likeness

18. In participating in any of organized Events, a participant automatically grants to the Service Provider the right to use his image on the Providers Website or Social Media Platforms

Boat Charter

19. Service Providers can organize a boat charter but it’s not mandatory. 
20.  Charter boats will be delivered:

• WITH: hull fittings, two mainsheet blocks attached to the hull (one of them a ratchet block), mast block, airbags, padded toe straps, shock-cord to keep the dagger board in place (Class Rule 3.3.5), racing spars, racing foils, bowline, paddle, bailers, trolley
• WITHOUT: mainsheet, and becket (to attach the mainsheet to the boom), dagger board safety cord (Class Rule 3.3.4), wind indicator or any fitting at the top of the mast to secure the lacing lines at the throat point.
• Sails will not be provided

21. It is a sole responsibility of the sailor to look after the boat and equipement. All of the damages and losses will be deducted from the damage deposit. We recommend purchasing boat insurance during the registration process.
22. A damage deposit of 300 EURO will be charged at The beginning of the Event and refunded at its end provided the boat and equipment is in good condition.
23. Damage deposits shall be paid in cash (EURO) only.

Risk Statement

24. Participants enter the Event entirely at their own risk and responsibility and each competitor and the responsible adult agree and acknowledge that:

• They are aware of the inherent element of risk involved in the sport and accept responsibility for the exposure of themselves and their boat to such inherent risk whilst taking part in the event;
• They are responsible for the safety of themselves and their boat, and their other property whether afloat or ashore.

Insurance 

25. Participants are obliged to have a valid third party insurance prior to the Event, letterhead to the sailor, cover of not less than € 1.500.000,00 and are required to produce evidence of such insurance written in English and clearly indicating the name of the sailor(s), the period Insurance coverage and the euro amount of the insurance, during registration.
